Pender Harbour's Dock Management Plan and DRIPA Challenge
The Pender Harbour and Area Residents Association (PHARA) on BC's Sunshine Coast has published an overview of the Pender Harbour Dock Management Plan. The plan is a provincial and shíshálh Nation framework governing docks, boathouses and foreshore leases.
PHARA says the plan has been expanded repeatedly since it was introduced in 2015. Proposed amendments would have extended it to freshwater lakes across the shíshálh swiya, restricted docks for private vessels over 30 feet, and required boathouses to be removed at the end of their tenure. PHARA has challenged the constitutional validity of the Declaration on the Rights of Indigenous Peoples Act (DRIPA) in BC Supreme Court as it applies to dock permits.
The overview is a useful reference for lake property owners watching how foreshore decisions are made here.
